Subsection: DATE OF ELIGIBILITY

DEFINITION

The effective date of eligibility under the Public Service Management Insurance Plan (PSMIP) means:

  1. with respect to employees of any board, commission, corporation or other portion of the Public Service of Canada specified in Schedule I of the Public Service Management Insurance Directives, the date on which it is so specified (refer to section IAM 4.2.1 of the Insurance Administration Manual (IAM)):
  2. with respect to part-time employees, September 1, 1982; and
  3. with respect to all other employees, November 1, 1970.

RULE 1

Persons employed in a managerial or confidential position are considered for PSMIP purposes to have been so identified by the Treasury Board:

  1. on the date of employment, if the position has been identified as excluded; or
  2. on the 10th working day following the date on which the department proposes the position for exclusion to the Treasury Board of Canada, in cases where the position is newly created or new functions have been assigned to an old position.

RULE 2

  1. Full-time and part-time employees satisfying rule 1 and taken on strength for an indeterminate period or for a term of more than six months are eligible immediately upon appointment.
  2. Full-time and part-time employees satisfying rule 1 and taken on strength for a term of six months or less and who:
    1. are appointed to another term of six months or less are eligible the day following completion of six months of continuous employment in the public service;
    2. are appointed for another term of more than six months or for an indeterminate period are eligible on the date of the new appointment.

DEFINITION (part 2)

| For the purpose of the completion of six months of continuous employment, a break in service of one working day or more (termination of employment) will interrupt the continuity.

| Note: For the purpose of the completion of six months of continuous employment, a statutory holiday will not count as a working day.

The six months of continuous employment may include a period of employment that is not managerial or confidential in nature.

Part-time employment where the assigned hours are one-third or less of the normally scheduled full-time hours for the employee's occupational group cannot be used in the calculation of the six months of continuous employment.

EXAMPLE 1

  • Taken on strength on March 4 in a managerial or confidential capacity, for an indeterminate period.
  • If the position has been identified as excluded, then the date of eligibility would be March 4.
  • If the position was instead a newly created position which was proposed for exclusion to the Treasury Board on March 15, then the date of eligibility would be 10 working days later.

EXAMPLE 2

  • Taken on strength on April 2 in a managerial or confidential position for a term of four months.
  • Struck off strength on August 6.
  • Taken on strength again on August 9 for a term of five months.
  • Appointed on January 9 for another term of five months.
  • Date of eligibility is February 9.

| (The first period of four months does not count for the completion of the six months of continuous employment. A break in service of even one working day interrupts the continuity for the completion of the six months of continuous employment).
