Code of conduct for all businesses operating at the Esquimalt Graving Dock

This code of conduct has been modified to meet Canada.ca Content Style Guide standards. The current code of conduct was issued June 5, 2017. One senior official of each business operating out of the Esquimalt Graving Dock will have acknowledged in writing to the direct of the dock that they have read and understood the content of the code of conduct.

1. Objective

The objective of the following code of conduct is to outline the corporate values, responsibilities, obligations and ethical polices that all businesses are to following while operating at the Esquimalt Graving Dock (EGD).

As a multi-user, open access facility, owned by the people of Canada, we value transparency and integrity. Conducting business at the EGD is a privilege, not a right. It is expected that the users of this facility will respect the EGD’s established processes and systems and will not use these processes and systems to the detriment of another user. It is also expected that the behaviour of businesses using this facility reflect the expectations of Canadian taxpayers.

The values that are important in the conduct of business at this facility include:

  • integrity
  • responsibility
  • professionalism

These values are the minimum standards that are to be adhered to. The behaviours associated with these values directly impact and reflect on the reputation of the EGD.

Public Services and Procurement Canada is committed to ensuring strong workplace ethics. In support of the department’s own ethical blueprint, it is expected that users:

  • conduct themselves with integrity and treat others with respect
  • act in the best interest of the public
  • respect the commitments of this federal government facility

2. Guiding principles

All businesses operating at the EGD are to abide by the following:

  • the Government of Canada operates the EGD as an open, public facility, providing service on a first-come, first-served basis
    • engaging in behaviour contrary to its use as a unique public facility does not allow for a healthy and competitive marketplace on the West Coast
  • the EGD is committed to managing the actual and potential health and safety, environmental, security, financial and public relation risks pertaining to strategies, policies and practices
  • as a designated port, the EGD will adhere to the commitments required for international security as determined by the International Ship and Port Security (ISPS) legislation
  • businesses have a responsibility to maintain an environment where conflict and difference can be addressed in a manner characterized by respect and civility
  • all businesses are to accept responsibility for their actions and activities
  • ethical behaviour and goodwill demonstrated by all businesses is expected

3. Application

This code of conduct applies to all users conducting business at the EGD.

4. Ethical values

As an open access, multi-user public facility, owned by the Government of Canada, businesses operating at EGD will demonstrate:

  • democratic value: by complying with Canada’s obligations and all relevant laws to serve the public interest
  • professional value: by being accountable and responsible as a corporate body
  • ethical values: by being accountable at all times to preserve public confidence and the integrity of the Government of Canada
  • people values: by demonstrating respect, fairness, openness and courtesy in dealings with Esquimalt Graving Dock staff, clients, suppliers, stakeholders, colleagues and citizens of Canada

5. Business requirements

The EGD is a dynamic world-class facility that, in partnership with the private sector, provides high quality, on-time service to national and international clients. The EGD reputation is based on:

  • the prudent management of assets
  • the provision of quality services which meet customer needs
  • a competitive industry
  • good faith in all agreements

As a federally owned facility, the EGD reputation is a reflection on the Government of Canada.

Management of the EGD will hold all businesses accountable for their actions and hold everyone to the highest standard of respectful and responsible behaviour. The EGD will only seek business relationships which:

  • do not negatively affect the reputation of the EGD
  • support its standards of service quality and efficiency
  • support its objectives and contribute to the growth of the industry
  • support its business principles and environmental objectives
  • are mutually beneficial and lead to success through fair dealing and high standards of business integrity

6. Standards of behaviour

All businesses operating at the facility must:

  • respect and comply with all applicable local, national and international laws, regulations, treaties and industry standards
  • comply with the EGD best management practices manuals (as may be amended from time to time)
  • treat one another with dignity and respect at all times
  • communicate the provisions of this code of conduct to all employees engaged in work at the EGD
  • demonstrate a responsibility to contribute to the EGD reputation by carrying out work conscientiously, efficiently and honestly while maintaining the highest standards of integrity and conduct in all operations that affect the EGD
  • show proper care and regard for the property and assets belonging to the Government of Canada and the property and assets of others
  • not misrepresent the services and equipment provided by the Government of Canada as services and equipment provided by the business
  • not intentionally obstruct the operations of any business carrying out work at the EGD
  • identify the business, in advertising and in communications with others, as a tenant or user of the EGD, a Government of Canada facility, providing services to marine operators or shipping companies
  • implement systems and processes to identify, measure, mitigate, minimize and report on actual and potential risks
  • be a good corporate citizen by respecting and adhering to the commitments of the EGD Environmental Management System, including mandatory attendance at the Joint Users Safety and Environment Committee, compliance with all audits, and the participation in all practice drills
  • conduct business in a manner that considers and mitigates negative impacts to the environment and to the health, safety and well-being of all on-site users and the surrounding community
  • engage senior executives in immediate corrective action where there is an immediate negative impact or threat to the environment or health and safety of others
  • request the director’s approval for all media access to the EGD site, which will not be unreasonably denied
  • demonstrate a willingness to cooperate with other users of the EGD
  • ensure that all subcontractors working at the EGD receive a copy of this code of conduct

7. Acknowledgement and compliance

One senior officer of each business operating out of EGD will acknowledge in writing (in a timely manner), to the Director, Esquimalt Graving Dock that they have read and understood the content of this code of conduct through the provision of an authorized signature on page 5 of the Esquimalt Graving Dock Code of Conduct.

EGD Management will monitor compliance to this code of conduct, as well as compliance with all relevant federal, provincial and municipal acts or laws. In the case of non-compliance, violations will be reported to the appropriate authority and businesses will be contacted and required to take corrective and preventative actions.

Failure to comply with this code of conduct could result in EGD Management:

  • denying access to the EGD properties
  • cancelling an existing lease/licence agreement
  • failure to enter into a new lease/licence agreement
  • failure to renew an existing lease/licence agreement
